CIR files tax reference in SHC against M/s Engro Fertilizer Ltd

KARACHI: Commissioner Inland Revenue Zone – I Large Taxpayers Unit (LTU) approached the Sindh High Court (SHC) challenging impugned order of the appellate tribunal over recovery of Rs335,691,694 in respect of sales tax from M/s Engro Fertilizer Ltd.

According to the details, counsel of the applicant stated in its tax reference that taxpayer is engaged in the business of manufacturing and supplies of locally manufactured fertilizer. A show cause notice was  issued to it for recovery of sales tax of Rs335,691,694 along with default surcharge and penalty under section 11 (2) 34 and 33 of the Sales Tax Act 1990.

Being aggrieved, taxpayer approached commissioner Inland Revenue Appeals-I which directed it to pay said amount, however, appellate tribunal finely passed an order in the favor of said taxpayer.

Citing M/s Engro Fertilizer Limited as respondent, applicant pleaded the court may set aside impugned order of the appellate tribunal and restore its order.
