IHC issues directives in three tax matters filed against field offices of FBR

ISLAMABAD: The Islamabad High Court (IHC) has issued directives in three tax matters involving field offices of the Federal Board of Revenue (FBR) during third week of March.

The court had issued directives to the Appellate Tribunal Inland Revenue (ATIR), Large Taxpayers Unit and others while hearing the cases filed by M/s CMPak Limited, M/s Werrick Pharmaceutical and M/s Mobizone Pakistan (Private) Limited.

Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb heard M/s CMPak Limited’s case. It had filed the case challenging an announcement made by the Appellate Tribunal Inland Revenue (ATIR), through which it had sustained decision announced by the department’s adjudication pertaining to the show cause notice issued to M/s CMPak Limited in head of federal excise duty (FED).

IHC bench comprising Justice Aamer Farooq and Justice Mohsin Akhtar Kiyani also heard the matter filed by M/s Werrick Pharmaceutical. It was filed in 2016.

M/s Werrick Pharmaceutical had challenged a recovery claim made by field office of Federal Board of Revenue (FBR).

M/s Werrick Pharmaceutical had filed the reference in which the company had challenged a show cause notice issued by the Large Taxpayers Unit, Islamabad.

The bench comprising Justice Athar Minallah and Justice Mohsin Kiyaani heard the complaint of M/s Mobizone Pakistan Private Limited. The court issued notices to parties in this case including the ATIR.

M/s Mobizone Pakistan Private Limited had filed the reference in which the company had challenged a show cause notice issued by the Large Taxpayers Unit, Islamabad.

M/s Mobizone Pakistan Private Limited submitted before the court that the impugned order was issued under mala-fide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard. It also stated that due legal course was not followed by the department in issuing the order.
