M/s Mujtaba Traders challenges demand notice of Rs06.2m

KARACHI: M/s Mujtaba Traders has moved the Sindh High Court (SHC) challenging the impugned demand notice of Rs06.2million for the tax year 2015 issued by Assistant Commissioner Inland Revenue Unit-12, Zone-III.

Counsel for the petitioner stated in the constitutional petition that petitioner is fulfilling all the liabilities regularly and never has been involved in any case of tax evasion. However Assistant Commissioner Inland Revenue Unit-12, Zone-III, issued a show cause notice for demand of Rs06.1million for the tax year 2015 without showing any lawful reason.

Counsel argued that being aggrieved, petitioner filed an appeal before Commissioner Inland Revenue Appeals-III along with a stay application which is pending for disposal. However during the pendency of these applications, petitioner is being threatened by the authorities concerned.

Citing Secretary Revenue Division, Commissioner Inland Revenue Appeals, Assistant Commissioner Inland Revenue Unit-12, Zone-III and office Inland Revenue Unit-V Zone-III, Regional Tax Office-II, as respondents, petitioner pleaded with the court to direct the appellate authority to decide its appeal within a reasonable period. Till final disposal, the court may restrain the tax department from taking any coercive action against the petitioner.
