SHC issues notice to M/s APL Pakistan on tax reference filed by commissioner Inland Revenue

KARACHI: The Sindh High Court (SHC) has issued notice to M/s APL Pakistan (Private) Limited for second week of May 2017 on an income tax reference filed by commissioner Inland Revenue Zone-I Large Taxpayers Unit, challenging impugned judgment of the appellate tribunal over recovery from M/s APL Pakistan.

While hearing of the income tax reference, a two-member bench, headed by Justice Aqeel Ahmed Abbasi also directed it to file its para wise comments on the next date of hearing.

Earlier, counsel for the applicant stated that a show cause notice was issued to the above named taxpayer for recovery of recoverable amount, however, being aggrieved, it approached before the commissioner Inland Revenue Appeals which was rejected, and therefore, taxpayer filed another appeal before appellate tribunal which allowed the appeal without considering facts and laws.

Citing M/s APL Pakistan Private Limited as respondent, applicant pleaded the court may set aside impugned judgment of the appellate tribunal and restore its order.
