KARACHI: The Customs Taxation & Anti-smuggling Court Judge Syed Faiz Rasool Rashdi awarded 16 days imprisonment and Rs50,000 fine to lady accused namely Samina Rafiq wife of Rafiq Ahmed who was booked in a case of attempting to smuggle/ non-duty paid mobile phones & auto parts from Dubai to Karachi. In default of payment of fine, she shall suffer further simple imprisonment for two months in Central Jail Karachi.
During the hearing, the said woman appeared before the court and moved application for plead guilty, therefore, court frame the charged against her and read over and explained to the lady in language which she understands very well viz Urdu and he was asked if she wants to plead guilty to the charge or claim to be tried, she replied plead guilty and left herself on the mercy of the court.
After the hearing, court awarded 16 days imprisonment (already undergone period) and Rs. 50,000 fine to her. According to the prosecution, on a credible information, officials of the customs department intercepted the accused lady Samina Rafiq and during examination of her baggage, recovered Motorola phones 50 numbbers, empty boxes for mobile phones and 5 kg auto parts tentative valuing of Rs5,50,000.
According to the investigation officer when she was asked the produced lawful documents of the above goods, she failed to produce any lawful documents, therefore, after the formalities, accused lady was arrested and goods were seized by Model Customs Collectorate Customs House Karachi.
Case was registered in violation of section 2(s) 16 and 139 of the Customs Act, 1969 punishable under clauses (8) (9) & 161 of the baggage rules, 2006 notified vide SRO-666(1)/2006 dated 28/06/2006 and Import & Export (Control) Act 1950.
