ATIR adjourns hearing of some important cases during 2nd week of April

ISLAMABAD: During hearing a case about outstanding tax complaint, Appellate Tribunal Inland Revenue (ATIR) issued notices to parties in a case submitted by M/s Pak Telecom Mobile Limited during recent week of April and adjourned hearing on a some other cases. ATIR Account Member Dr Ghulam Mujtaba Bhatti heard the matter and remanded back to the tribunal by the Islamabad High Court (IHC). M/s Pak Telecom Mobile Limited had contested show cause notices issued by the field offices of Federal Board of Revenue (FBR).

According to details, M/s Pak Telecom Mobile Limited had challenged recovery of issued to it in head of outstanding income tax by the LTU, Islamabad. Pakistan Telecom Mobile Limited had submitted the department had issued the demand for the tax year 2013 in head of income tax under provisions of Income Tax Ordinance, 2001. Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue, Commissioner InlandRevenue (Appeals) and Appellate Tribunal Inland Revenue (ATIR) were made respondent in the case.
Pakistan Telecom Mobile Limited prayed that the assessment order issued by the LTU officer was illegal, unlawful and without legal grounds.
The appellant had submitted before the court that the impugned order was issued illegally. It also stated that due legal course was not followed by the department in issuing the order.
However, the court again remanded back the cases for detailed decision or rehearing when the appellant’s approached the apex courts against announcements made by the tribunal.
