SHC grants bail to FPCCI president, six others in export refund fraud case

KARACHI: Sindh High Court (SHC) has granted bail to Federation of Pakistan Chambers of Commerce & Industry (FPCCI) President Zubair Tufail and six others in an export refund fraud case.

The SHC division bench, comprising Justice Junaid Ghaffar and Justice Muhammad Humayoon Khan, admitted to bail of Zubair Tufail, Pervez Tufail, Salam Tufails and four others of InterPlas against a solvent surety of Rs 500,000 each.

The bench earlier heard Barrister Farogh Naseem who representing the applicants submitted that National Accountability Bureau (NAB) under the garb of investigations are harassing the applicants. The allegations pertain to alleged export rebate fraud case which is beyond the jurisdiction of NAB, he submitted.

A bench of SHC has declared 3 per cent sales tax (value addition) paid by the applicants null and void after which a refund of Rs75 million became due in favour of accused and to save this money, they were being harassed under concocted allegations, the counsel submitted establishing mala fide by the income tax/sales tax authorities.

According to details, applicants/accused during 2010-12 imported PMC (Plastic Moulding Compound) commonly known as ‘plastic dana’ used for manufacturing plastic goods. They sold the consignments in open market. Three of the bulk purchasers later after value addition re-exported the PMC and claimed some rebate.

The NAB authorities investigated the case against the exporters and also roped in the present applicants who had no nexus with the acts of purchasers after open market sale.
