ISLAMABAD: The Islamabad High Court (IHC) has directed the Appellate Tribunal Inland Revenue (ATIR) to rehear the petitions with regard to the cases carrying unsettled tax claims.
M/s Pakistan Medical Cooperative Housing Society had filed case about outstanding tax liability. The appellant had filed both cases against ATIR and FBR.
While hearing the first case, the IHC directed the Appellate Tribunal Inland Revenue (ATIR) to decide appellant’s appeal within 60 days. The court also directed the Regional Tax office, Islamabad to abstain from realizing the recovery.
M/s Pakistan Medical Cooperative Housing Society had challenged RTO order, dated April 23, 2015, issued by the Assistant Commissioner Inland Revenue, RTO.
The other cases was also decided in similar way in which the court restrained the Federal Board of Revenue (FBR) from recovering outstanding tax amount of Rs3,600,625 from M/s Pakistan Medical Cooperative Housing Society.
And also issued directions to the Appellate Tribunal Inland Revenue (ATIR) to decide appellant’s appeal within 60 days and submit report at the court.
The court has also directed the ATIR to submit court’s orders compliance report at IHC administration about the cases. The court heard the cases in the recent week of May.
Meanwhile, Justice Athar Minallah dated in office hearing on M/s Pakistan Mobiles Communication Limited case. Some other tax matters were also adjourned by the court.
