SHC bars tax authorities from taking action against M/s Loreal Pakistan

KARACHI: The Sindh High Court (SHC) has restrained the FBR authorities from recovering disputed amount from M/s Loreal Pakistan (Private) Limited during pendency of the case. The Additional Commissioner Inland Revenue, Large Taxpayers Unit, had issued a notice to recover disputed amount from the petitioner.

While the hearing of petition, a two-member bench, headed by Justice Muhammad Ali Mazhar, also issued notices to the tax authorities and deputy attorney general, directing them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner submitted in its constitutional petition that said respondent issued a notice for recovery of disputed amount and being aggrieved it moved to commissioner Inland Revenue Appeals and filed an appeal along with stay application which is pending for disposal, however, during pendency of such appeal, tax department directed the petitioner to submit disputed amount, otherwise amount would be collect from petitioner’s bank accounts.

Citing Chairman Federal Board of Revenue, commissioner Inland Revenue Large Taxpayers Unit, Additional Commissioner Inland Revenue Large Taxpayers Unit and others, counsel for the petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary, he also pleaded the SHC may restrain them from taking any coercive measures till final decision of its appeal pending before Commissioner Inland Revenue Appeals.
