Customs Appellate Tribunal decides reference in favour of M/s Yarkan

ISLAMABAD: A customs reference has been filed with the Customs Appellate Tribunal for rehearing by M/s Yarkan’s case decided in favor of Collectorate of Customs, Islamabad.

Customs Appellate Tribunal’s Member Technical, Muhammad Nasir Khan and Syed Muhammad Anwar would hear the matter.  The case was carrying matter about wrong evaluation of imported goods.

Earlier, Customs Appellate Tribunal had Bench-II heard the case. M/s Yarkan had filed the case against Colelctorate of Customs, Islamabad. The appellant had challenged a decision announced by departmental adjudication in which it had maintained to seize imported fabric items by M/s Yarkan.

The adjudication had found the importer of guilty of misevaluation of imported goods. The decision stated that the items were cleared for value & 3.75/kilogram, however, the inquiry found its actual value as of Rs & 5/kilogram. Thereby, a difference of Rs281,163,4 had occurred in evaluation of cost-duty ratio with the said findings, the adjudication maintained to seize the imported fabric items.

The appellant had challenged the decision before the tribunal and a single bench of the tribunal. Now the matter was likely to be taken soon by the tribunal.
