M/s Hatter Steel Re-Rolling Mills for fixation of wrong valuation of Ferro Manganese

KARACHI: The Sindh High Court (SHC) has issued notices to the customs authorities and deputy attorney general on a constitutional petition filed by M/s Hatter Steel Re-Rolling Mills for fixation of wrong valuation of Ferro Manganese.

While the hearing of petition, a two-member bench, comprising Justice Munib Akhtar and Justice Umar Sial, directed them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner stated that it is engaged in the lawful business of import of Ferro Manganese and always fulfills all legal requirements. The counsel added that petitioner imported the above mentioned goods and filed goods declaration (GD) in accordance with law.

The counsel informed the court that, petitioner declared $905.00/ MT, however, customs department fixed the valuation at $1030/MT without lawful authority.

Citing Secretary Revenue Division, Collector of Customs Collectorate Appraisement East, Directorate General of Valuation as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, court to direct them to collect the valuation according with law. He also pleaded the court to restrain them from taking any coercive action against the petitioner.
