Customs Appellate Tribunal rejects appeal filed by M/s Shakir Ullah

LAHORE: Customs Appellate Tribunal has dismissed the appeal filed by M/s Shakir Ullah against Director General, Intelligence and Investigation-FBR Lahore and Collector of Customs (Adjudication).

As per details, staff of Intelligence and Investigation, received information that huge quantity of foreign origin non duty paid goods have been stored at the premises of M/s TCS logistics Multan Road Lahore.

After getting warrant from the judicial forum a raiding party conducted the raid but due to night time search of warehouse was not possible so the same was sealed. After that the raiding parties search the premises and found air conditioner, refrigerators, washing machines and vacuum cleaners.

The raiding team asked the owner of the godown who was present at the time of raid to produce legal documents regarding possession of these goods, but the owner who was identified as Shakir Ullah failed to produce any legal documents against the seized goods.

After that customs team seized the goods and after registering a case forwarded the case to Customs Adjudication for further proceedings.

Customs Adjudication passed Order-in-Original (ONO) passed against the party who aggrieved from order and challenged before the Customs Appellate Tribunal on the grounds that earlier judicial forum passed the order in mechanical fashion, without knowing the facts of case so impugned order is liable to set aside.

On the other side, same type of appeal filed by the department against the same appellant before the Customs Tribunal.

After examining and complete hearing of case Customs Appellate decided the case with remarks that there is no need to alteration and modification of impugned order so dismissed appeal.
