SHC seeks comments on petition seeking release of three vehicles

KARACHI: The Sindh High Court (SHC) has directed parties to file their respective para wise comments on a constitutional petition filed by Muhammad Hussain, seeking release of his three vehicles seized by the customs authorities. A two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, was hearing the petition.

Earlier, counsel for the petitioner stated that he is lawful owner of three vehicles bearing registration number P-5067, TTC-697 and LOK-7437 and never involved in any criminal case, however, the customs authorities seized the vehicles illegally. He said that the petitioner produced lawful documents before the authorities, but they are not following any lawful procedure.

Counsel further submitted that being aggrieved he moved the customs appellate tribunal and filed an appeals against seizing of his vehicles which allowed his appeals and directed concerned authorities to release his vehicles, however, officials of the customs department declined his request without considering order of the customs appellate tribunal.

Citing Customs Appellate Tribunal and other customs officials as respondents, petitioner pleaded the court may direct the respondent to release his vehicles immediately and restrained them from taking any coercive action till final order in this petition.
