M/s Smartex Int’l moves SHC against levy of duty & taxes on consignment of LED lights

KARACHI: The Sindh High Court (SHC) has issued notices to the customs officials and deputy attorney general on a constitutional petition filed by another importer namely M/s Smartex International against imposition of duty and taxes on consignment of LED lights.

While the hearing of the petition, a two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, directed the office to connect the same with other constitutional petitions.

Earlier, counsel for the petitioner stated that he is engaged in the lawful business of import of the above mentioned goods and is entitled to concessions under 5th Schedule of the Customs Act, 1969. The counsel said that the officials of the Model Customs Collectorate Appraisement did not accept the assessments made by the petitioners on the ground that the petitioners’ goods were not entitled for relevant exemptions.

Citing Chairman Federal Board of Revenue, Collector of Customs Model Customs Collectorte Appraisement West, the Engineering Development Board Alternate Energy Department Board as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary. He also pleaded the court may declare that above mentioned goods are entitled under 5th schedule of the customs laws.
