SHC issues notices to Customs, others in fabric dyes case

KARACHI: The Sindh High Court has issued notices to Pakistan Customs and others for Dec 06 in a petition challenging detention of fabric dyes.

The bench, comprising Justice Munib Akhtar and Justice Omar Sial, earlier heard counsel for petitioner Jiya Enterprises. Hyder Shaikh advocate of Franklin Law Associates submitted that the consignment consisting of fabric dyes was released in the first instance but was detained for re-assessment. After reassessment for second time, the consignment was put on “hold” ground that wrong PCT heading was mentioned in the Goods Declaration (GD).

The counsel for petitioner maintained that if there is any dispute of PCT heading that the Classification Committee is the relevant forum and body to decide the controversy and as such orders of detention by Deputy Collector are illegal and beyond jurisdiction.

The bench after perusing the papers and impugned order, issued notices to the respondents for Dec 06 while restraining the department from any adverse action against the petitioner/importer.
