ADC Adjudication Saeed orders impounding of generator, truck

FAISALABAD: Collectorate of Customs Adjudication Additional Collector Saeed Asad has ordered the impounding of a foreign origin generator along with a carrier truck.

The additional collector issued an Order-in-Original (ONO) in favor of the Sargodha Customs Anti-smuggling Organization while deciding the case.

In pursuance of a tip-off, the customs staff intercepted a truck bearing Registration No: 3209 near Dawood Khel Road Sargodha and found the imported diesel generator.

Driver of the truck named Arshad Mehmood son of Muhammad Yaqoob was asked to produce any documentary evidence showing the legal import of the generator. He produced a copy of the GD vide Machine No: 2164. But no other required import-documents such as commercial invoice packing list were presented.

Therefore the truck along with the loaded item was taken into possession under the customs bylaws, and the case was sent to the Customs Adjudication for further proceeding. However the respondent showed his willingness to pay the taxable duties on the seized foreign origin generator.

Additional Collector, after hearing the arguments, issued the ONO. He ordered the seizure of the item under Section 156 (1), 90 of the Custom Act-1969 read with SRO 499 (1) and also ordered the impounding of the truck under Section 157 (2) of the Custom Act-1969.

The Additional Collector offered the accused an option to redeem the vehicle on the payment of Rs100000 under Section 181 of the Custom Act.
