KARACHI: The Sindh High Court (SHC) has sought comments from the Customs Department on a constitutional petition filed by M/s Al Shaikh Associates against Valuation Ruling No 1268/2018 issued on March 7, 2018 enhancing 100 percent valuation on import of roller chain.
Counsel for the petitioner stated that the petitioner is roller chain importer in the brand of M/s Al-Shaikh Associates and always fulfills all the liabilities in accordance with law and never involved in any crime.
The counsel argued that the petitioner is seriously aggrieved by the action of the Collector of Customs Collectorate Appraisement East which issued and assessed the imported consignments of the roller chain under valuation ruling no 1268/ issued on March 7, 2018, enhancing 100 percent valuation without fulfilling legal requirements.
Citing Chairmen Federal Board of Revenue, Chief Collector of Customs Collectorate Appraisement South, Collector of Customs Collectorate Appraisement East, Director General Valuation as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to set aside impugned notification and restrain them from taking any coercive action against the petitioner till final order in this petition.
