KARACHI: M/s Inovi Technologies has moved the Sindh High Court (SHC), challenging imposition of regularity duty on import of refrigerators, air conditioners, washing machines and other similar goods under Valuation Ruling Number 1035(1)/2017 dated Oct, 16, 2017.
In his constitutional petition, counsel for the petitioner stated that it is engaged in the lawful import of the above mentioned goods and always fulfills his liabilities according to the law, but is dissatisfied with the unlawful imposition of regularity duty on import of goods vide SRO 1035(1)/2017 dated Oct, 16, 2017.
The counsel argued that the petitioner has no other remedy but to prefer the titled constitutional petition, challenging inter alia, imposition of the regularity duty.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Collectorate Appraisement West, Collector of Customs Collectorate Appraisement East and Collector of Customs Collectorate Appraisement Port Muhammad Bin Qasim as respondents, importer pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to set aside impugned valuation ruling and restrain them from taking any coercive action against the petitioner till final order in this petition.
