LAHORE: Customs Appellate Tribunal has accepted the appeal in imported air handling units and accessories from UAE. The same appeal was filed by M/s Don Valley Pharmaceuticals Private Limited against Collector of Customs (Appeals) Lahore and others.
Imran tariq, member technical bench-I heard the arguments from both sides and decided the appeal with arguments after examining all record the case concluded that Order in Original has set aside and appeal is accepted.
As per brief history of case, M/s Don Valley Pharmaceuticals Private Limited was imported a consignment of different typed of air handling units and accessories form UAE and sought clearance under DG No SC 14765 through M/s Allied Enterprises.
After the examination from the customs department some discrepancies are ground in between imported items and Clarence note. The case was adjudicated and order in original was passed with remarks that appeal is rejected because this authority feels that there is no need to interfere in the same appeal.
The order was challenged before the Customs Appellate Tribunal on the grounds that order in original not according to the facts of case also passed beyond the law. Appellant counsel also produce some documents showing lawful imports of the same items and prayed before the tribunal that impugned order is liable to set aside. On the other side, respondent denied allegations and prayed for the rejection of appeal.
After hearing the arguments from both sides, Customs Appellate Tribunal has accepted the appeal and set aside the order passed by the earlier authority in the same case.
