Customs Appellate Tribunal remands back appeal of impounded Land Cruiser case

LAHORE: Customs Appellate Tribunal has accepted the appeal and set aside the impugned order in original in seized Toyota Land Cruiser case. The appeal was filed by the Muhammad Iqbal, a resident of Rawalpindi against Collector of Customs (Adjudication) Customs House Lahore and others.

Muhammad Shabbir Gujjar, member judicial, heard the arguments from both parties and decided the appeal with remarks that impugned order is set aside and matter is remanded back to the learned collector of Customs (Adjudication) for serious consideration after providing opportunity of hearing to both parties within 45 days from announcement of judgment.

As per brief history of case, on the information received from credible source customs staff was intercepted a Toyota Land Cruiser. On demand, driver failed to produce documents showing lawful import of vehicle and same were seized under Customs Act 1969.

Show cause notice were issued and adjudication proceeding were culminated and order in original passed against the owner of vehicle.

Being aggrieved from the order appellant filed the appeal before the Customs Appellate Tribunal on the grounds that order passed by the adjudication authority is against the law and facts regarding the merit of case and same is liable to set aside. On the other side, respondent department denied all allegations and pray for rejection of appeal.

After hearing of arguments and examining of record the same appeal has remanded back for fresh hearing. Also orders to the relevant judicial forum to give the opportunities of hearing to both parties.
