SHC directs to issue delay certificate on petition filed by M/s A & T Cottex

KARACHI: The Sindh High Court (SHC) has directed customs officials that delay detention certification to be issued as per applicable rules and regulations on a constitutional petition filed by M/s A & T Cottex against imposition of regularity duty on import of different goods.

While hearing of the petition, a two-member bench, headed by Justice Munib Akhtar, also issued notices to the customs officials and deputy attorney general, directing them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner stated that it imported different goods from China lying at port and filed Goods Declaration according with law, however, officials of the customs department imposed Regularity Duty on import goods imported by the petitioner under valuation ruling 1035(1)/2017 illegally.

Citing Secretary Ministry of Revenue, Collector of Customs Collectorate East, Collector of Customs Model Customs Collectorate West and Collector of Customs Model Customs Collectorate Port Muhammad Bin Qasim as respondents, he pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary. He also pleaded the court to restrain them from taking any coercive action against it till final order in this petition.
