Customs Appellate Tribunal sets aside impugned order in seized Toyota Hilux

LAHORE: Customs Appellate Tribunal has dismissed the appeal in seized Toyota Land Cruiser case. The same appeal was filed by Chaudhary Ali Mubashir against Collector of Customs (Appeals) and others.

Muhammad Shabbir Gujjar, member judicial bench-I, heard the arguments from both parties which they submitted before the tribunal, same appeal was decided with remarks that appeal is not according to the merit and same is dismissed.

According to details, assistant collector Anti Smuggling Organization, on the credible information impounded Toyota Land Cruiser. After matching data with Excise and Taxation department the same vehicle was seized under the relevant law.

The driver also failed to showing documents regarding lawful import of goods and section 2 (kk) of Customs Act applied by the department for further investigation.

After show cause notice, adjudication proceeding were culminated by the authority and declared that Toyota Land Cruiser is confiscated outrightly.

Being aggrieved from the impugned order, appellant filed the case before the Customs Appellate Tribunal with grounds that impugned order is passed against the facts and without out consideration of law.

Appellant also produced documents showing lawful import of vehicle and appeal to suspend the order passed by the adjudication authority. On the other side, respondent denied the allegations and appeal for rejection of case.

After hearing the arguments from both sides, Customs Appellate Tribunal has decided the case with remarks that impugned vehicle is not imported legally, Order in Original is upheld and appeal is rejected with no order.
