LAHORE: Customs Appellate Tribunal has upheld impugned order and dismissed the appeal in seized Hino Ranger truck. The appeal was filed by Hazoor Buksh, a resident of Jafferabad against additional collector of Customs (Adjudication) and others.
Omer Arshed Hakeem, member judicial bench-II, heard the arguments from both parties which they submitted before the tribunal. Same appeal was decided with remarks that appellant failed to prove the legality of goods so the appeal is dismissed and order in original is upheld.
According to details, the staff of Customs Intelligence and Investigation-FBR was intercepted a Hino Ranger truck. On demand, the driver also failed to produce any legal documents regarding import of vehicle and after the complete examination same goods were seized under Customs Act 1969.
After show cause notice, adjudication proceeding were culminated by the authority and order-in-original was passed with remarks that Hino Ranger truck was confiscated out rightly.
Being aggrieved from the impugned order, appellant filed the case before the Customs Appellate Tribunal with grounds that impugned order is passed against the facts and without consideration of law.
Appellant also produced documents of import of vehicle and appeal to suspend the order passed by the adjudication authority. On the other side, respondent denied the allegations and filed appeal against rejection of case. After hearing the arguments from both sides, Customs Appellate Tribunal has upheld order-in-original and dismissed the same appeal.
