Customs Appellate Tribunal directs collector to restore DTRE of M/s Peena Overseas Corp

LAHORE: Customs Appellate Tribunal has accepted the appeal in allegedly misuse of DTRE certificate in the appeal filed by M/s Peena Overseas Corporation against Collector of Customs Sialkot and Collector of Customs (Adjudication).

Muhammad Shabbir Gujjar, Judicial Member, heard the arguments from both parties and decided the case with direction to collector customs, collectorate Sialkot to restore DTRE approval of importer.

According to the details of case, customs team during scrutiny of documents noticed that importer M/s Peena Overseas Corporation has imported 23,736 meters of Black PU coated poly fabrics and short paid Rs 1,147,991.

After show-cause notice, adjudication proceeding were culminated and order in original passed against the importer who aggrieved with the order and filed the appeal before the Customs Appellate Tribunal.

Appellant raise a points that he imported 23,736 meters of Black PU coated poly fabrics under the law and he paid all taxes and duties which were payable by him. Adding more that adjudication order is against the law and passed in mechanical fashion without consideration of facts of case.

On the other side, respondent department denied all allegations and produce proof on which the taxes and duties charged on the importer and also appeal for rejection of case.

After hearing arguments from appellant and respondent side, Customs Appellate Tribunal has accepted the appeal filed by the importer  M/s Peena Oversease Corporation and directed to collector customs, collectorate Sialkot to restore DTRE approval of importer. Customs member also passed a judgment that this order is also apply on the same nature cases.
