Court disposes of suits for refund filed by Digicom, New Allied Electronic

KARACHI: The Sindh High Court has disposed of suits filed by Digicom Private Limited and New Allied Electronic Industries, importers of mobile phones.

Justice Junaid Ghaffar on Wednesday disposed of suits filed by the applicants seeking refund of money collected from them as Sales Tax charged in terms of SRO 280(1)/2013 and 460 (1)/2013 at import stage.

Khalid Rajpar advocate counsel for defendants Collector, Appraisement, South, Chief Collector, appraisement South and Collector Customs (Preventive) opposed the plea and said that department would consider the refund plea if the plaintiffs provides details pertaining to the consignments.

The sought details include copies of GDs involved in refund claim along with invoices, packing list, LC’s import forms, copies of sales Tax invoices of goods imported vide GDs involved in refund claims, copies of Sales Tax invoices of identical goods sold before the goods imported vide GD’s involved in the refund claims besides copies of refund application to the referred division of the concerned RTO/LTU in terms of CGO 03/2010 dated 27-10-2010.

The court, disposing of the suits, directed the defendants to decide the application within 60 days.
