Customs Court approves bail of suspect involved in assaulting customs officials

KARACHI: The Customs Court Judge Syed Faiz Rasool Rashdi on Friday granted interim pre-arrest bail to suspect namely Shah Muhammad alias Lali son of Bangal Khan, who was booked in a case of physically assaulting the customs officials, staff.

During the hearing, above mentioned suspect appeared before the court along with his counsel who moved petition for pre-arrest bail and argued that his counsel was falsely implicated in this case who is ready to face trial, however, he has apprehension of arrest.

After the hearing, court granted them bail without touching the merits of case against the surety of Rs. 2,00,000, court also directed him to join investigation of and when required by the investigation officer of the case.

Court issued notices to the special prosecutor for customs and called police papers, court also directed accused person to attend the court on next date of hearing for confirmation of bail or otherwise.

According to the prosecution, during a routine, officials of the customs department stopped a 10 wheeler truck at Mian Shafiq Petrol Pump near Hala Naka at National Highway, the truck was inspected and was reported to be containing Pan Parag and foreign origin cigarettes, while the driver was being questions, 4 vehicles approached and engaged the customs staff in very aggressive manner, showing arms of prohibited bore, one of the persons who was leading the assailants was identified as Shah Muhammad Lali along with 6 other armed persons physically assaulted the customs ASO, staff, during the scuffle, the driver managed to take away loaded with goods.

Case was registered against them for violation of under section 2 (s), 16, 158, 161, 164, 167, 168 & 178 of custom act, 1969, punishable under clauses 8 (I), 85 & 89 of section 156 (1) of customs act, 1969, the offence further invokes provisions of CRPC and PPC (will be invoked during the investigation).
