17 more importers challenge imposition of RD on tiles, sanitary

KARACHI: The Sindh High Court (SHC) directed Customs officials to file their comments on a constitutional petition filed by 17 importers, including M/s MI Sanitary Store, Brite Centre, M/s N.A Mukhtar & Company, against imposed regularity duty (RD) on tiles, sanitary ware and other similar goods.

Directives were issued by a division bench, headed by Justice Aqeel Ahmed Abbasi during Monday hearing.

Earlier, counsel for the petitioners stated that it imported consignments of tiles, sanitary ware and other similar goods from China and filed goods declaration (GD) as per law; however, officials of the Customs department imposed regularity duty on the same under SRO 1035(1)/2017 illegally and without having lawful authority.

Citing Chairman Federal Board of Revenue, Collector of Customs Port Muhammad Bin Qasim, Collector of Customs East and Collector of Customs West as respondents, counsel pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court to direct them to release their consignments as per law and restrain them from taking any coercive action against them till final order in this petition.
