Importers approach SHC seeking release of ceramic & porcelain on bank guarantees

KARACHI: M/s Asiatic International, M/s Zoaib Ali & Company and other 19 importers approached the Sindh High Court (SHC) seeking release order for their consignments of ceramic & porcelain on bank guarantees on Tuesday.

Counsel for the M/s Baba International, M/s Fine House, M/s Ateeq Enterprises, M/s Abu Yousaf Traders, M/s Pak Traders, M/s Shakeel Trading Corporation, M/s Bilal Corporation, M/s Insaf Traders, M/s Modern House, M/s A.R Traders, M/s Dura Tiles, M/s MS Traders, M/s Dyna Traders, M/s TM Ceramics, M/s Junaid Corporation, M/s Saad International and M/s Mahmood Son Pvt Ltd argued in their constitutional petition that they are conducting business of import and trade of goods having description ceramic & porcelain tiles which was determined under section 25A vide Valuation Ruling No 874/2016 dated 22/6/2016.

He argued that aforesaid valuation ruling was challenged under section 25-D against arbitrary enhancement customs values of subject goods. The court directed customs officials to release the consignments imported by the other importers after deposit of security to the Nazir in respect of differential amount of duty and taxes on the basis of difference between the declared value and value as per valuation ruling 874/2016 in similar cases.

Citing Chairman Federal Board of Revenue, Collector of Customs Collectorate West, Collector of Customs Collectorate East, Collector of Customs Port Muhammad Bin Qasim and Director General Directorate General of Customs Valuation as respondents, counsel pleaded the court to direct the customs officials to release their consignments on bank guarantee and restrain them from taking any coercive action against them till final order in this petition.
