KARACHI: The Sindh High Court (SHC) directed Customs officials to file their comments on different constitutional petitions filed by Amir Muhammad, Amir Nawaz Khan and other importers for seeking release of their imported Hino trucks and other vehicles seized by customs department due to alleged disputed valuation on July 30, 2018.
A two-member bench, headed by Justice Abdul Rasool Memon, heard the matter on August 2, 2018.
During the hearing, counsel for the petitioners including Amir Muhammad, Amir Nawaz Khan and others stated in their separates constitutional petitions that they are law-abiding citizens and in the normal course of business and they imported used Hino trucks and other vehicles under personal baggage scheme and has never been indulged in activities in derogation of law.
Counsel argued that after imported vehicles, they filed goods declarations for clearance of their vehicles; however, they were informed by the customs officials that their vehicles were seized by them due to disputed valuations.
Citing Sectary Revenue Division, Chairman Federal Board of Revenue, Collector of Customs Customs Collectorate Port Muhammad Bin Qasim Karachi and others as respondents, they pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary, counsels also pleaded that the court may direct them to release their vehicles immediately.
