Customs Appellate Tribunal orders to release 398 drums of seized oil

LAHORE: Customs Appellate Tribunal on 3.8.2018 quashed impugned order passed by the adjudication and orders the department to release goods to the appellant unconditionally.

The appeal was filed by one Abdul Razzaq, a resident of Alipur Chattha against Collector of Customs Adjudication Lahore and others.

As per brief facts of case, on the information receive from a source that huge quantity of Iranian smuggled oil stored in M/s New Five Star Filling Station, Gujranwala, customs staff obtained search warrants from the magistrate, the staff of Intelligence and Investigation-FBR, Rahwali Gujranwala recovered 398 drums of Iranian oil 29534 liters and same were seized under the Section 156(I) 89 of Customs Act 1969.

After show cause notice, adjudication proceeding were culminated and Order-in-Original was passed with remarks that smuggled oil is confiscated out rightly.

Being aggrieved with the order, appellant challenged Order-in- Original before the Customs Appellate Tribunal on the grounds that impugned order is illegal and beyond the law.

After hearing arguments from both sides, Customs Appellate Tribunal member judicial bench-II Omer Arshad Hakeem accepts appeal and order to release goods to lawful owner unconditionally.
