KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general on petition filed by M/s Sapna Builders seeking release of 395,085 kilogram used tyres cut into two and three pieces.
On September 13, 2018, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, heard the matter.
During the hearing, court issued notices to the parties and also directed customs officials to examine this aspect in the light of the relevant law and the import policy and may process against the petitioner in accordance with law.
During the hearing, counsel for the petitioner stated that petitioner is lawful importer of used tyres and always fulfills all the legal formalities. He submitted that it imported 395,085 kilogram used tyres cut into two and three pieces and filed goods declaration and paid applicable customs taxes and duties.
He further submitted that after fulfilling all the legal formalities, he approached the customs officials for release of said goods, however, they refused to release his consignment without lawful authority and seized it.
Citing Secretary Revenue Division, Collector of Customs Collectorate Appraisement East as respondents, he pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary. He also pleaded the court to direct them to release his consignment of said goods immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
