KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general on petition filed by M/s Hussain Technologies seeking release order of its consignment of juicer blender parts seized by customs officials due to disputed valuation.
During the hearing of petition, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, directed them to file their para-wise comments on next date of hearing.
On September, 18, 2018, counsel for the petitioner stated in his petition that petitioner is lawful importer of different types of home appliances and always fulfills the legal formalities.
Counsel informed the court that petitioner imported different goods including juicer blender parts and filed goods declaration according with law; however, he was informed by the officials of the customs department that his goods are not being released and they did not show any lawful reason.
He submitted that due to goods lying at the port incurring huge port demurrages detention charges and importer cannot afford the said charges.
Citing Chairmen Federal Board of Revenue, Collector of Customs Collectorate Appraisement East, Customs Appellate Tribunal and others as respondents, he pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary and they have no power to detain his consignment without shown reasons.
Importer also pleaded the court to direct them to release the consignment immediately and restrain customs officials, their agents, officers, staff and other who work for them from taking any coercive action against the petitioner till final order in this petition.
