KARACHI: The Sindh High Court (SHC) directed customs officials to make sure filing of their comments on a constitutional petition filed by M/s Dollar Industries Private Limited seeking release order for its bank guarantee amount submitted before for releasing of stationary’s consignments.
On October 04, 2018, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing the matter.
During the hearing, counsel for the petitioner stated that it is engaged in the lawful business of manufacturing, marketing, supplying and importing & exporting of stationary products including black lead pencils and color pencils.
He submitted that petitioner imported a consignment of stationary products and filed Goods Declaration (GD) according with law, however, officials of the customs department assessed the valuation as per Valuation Ruling no 1182/2017 and enhanced value of said goods and after submitting bank guarantee, the said goods were released. He argued that now despite clear directions of this court, officials of the customs department refused to release the bank guarantee amount.
Citing chairman Federal Board of Revenue, collector of Customs Collectorate East and others as respondents, he pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.
Importer also pleaded the court to direct them to release the bank guarantee and restrain them from taking any coercive action against the petitioner till final order in this petition.
