M/s Mark Enterprises registered on naib qasid’s name, documents disclose

KARACHI: The Sindh High Court (SHC) directed parties to file comments on a constitutional petition filed by Mohammad Zahid Anwar son of Anwar Hussain, Naib Qasid of provincial Health Ministry, shown as proprietor of M/s Mark Enterprises and booked in a case of more than Rs16o million sales tax evasion case.

On October 23, 2018, a two-member bench, headed by Justice Muhammad Ali Mazhar, heard the matter.

During the hearing, petitioner and his counsel appeared before the court and argued that he is a naib qasid in provincial Health Ministry; however, deputy commissioner-R, E&C Unit-01, Zone-01, RTO-11 issued a notice to him and demanded amount of Rs168,857,540 as proprietor of M/s Mark Enterprises.

He submitted that officials of the FBR also directed that “removal of goods from your business premises shall be stopped and the business premises sealed after by 05/01/2016 of issue of this notice till such time the amount of tax is paid or recovered in full” and you are also directed not to directly or indirectly, sell, mortgage, charge, lease or otherwise deal with all movable and immovable property belonging to you except with the permission of the undersigned”.

Petitioner also stated that when he moved company’s address than saw, there was no company and all contact numbers are also fake. He submitted that fake company case was registered on his name and despite the arrest of real culprits, officials of the FBR registered a case against him and also seized his salary’s account, which caused mantel torture.

Citing Deputy Commissioner IR, E&C Unit-01, Zone-01, RTO-11 and others, he pleaded the court to direct them to release his bank account and restrain them from taking any coercive action against him. He also pleaded the court to declare that he is innocent and his copy of NIC is used under criminal intentions by someone else as such he is not liable to pay any tax which he is not the alleged company holder.
