M/s Waris Sharif & Co approaches SHC for release of PVC clear sheet consignments

KARACHI: M/s Waris Sharif & Co approached the Sindh High Court (SHC) for seeking release order of the imported consignments of PVC clear transparent sheet flexible as well as those consignments which are in pipeline.

On January 15, 2019, counsel for the petitioner stated in his constitutional petition that petitioner is a regular importer of the above-mentioned goods and imported goods @$1.31 per kilogram worth $24,962.18 from China, however, respondents assessed the item @$1.60 per kilogram as per Valuation Ruling No 1317/2018 dated 17/08/2017.

He argued that due to enhancement of goods valuation under unlawful circular Si/MISC/13/2014-CC(APPR)/375 dated 22/11/2017 issued by the chief collector of Customs Appraisement South Karachi, thereby not allowing the release of goods under Section 81 of the Customs Act, 1969, besides the petitioner has filed the revision petition before the director general of customs valuation customs house Karachi, the same is still pending.

He submitted that petitioner has no remedy but to prefer the titled constitutional petition, challenging, inter alia, challenging the circular.

Citing chairman Federal Board of Revenue (FBR), Chief Collector of Customs Appraisement South, Director General of Customs Valuation and Collector of Customs Appraisement East as respondents, petitioner pleaded the court to declare that impugned circular as unlawful and respondents are under obligation to allow the clearance of duty paid goods under Section 83 of the Customs Act, 1969 without further delay and allow assessment under Section 81 of the Customs Act, 1969.

Importer also pleaded the court to direct the respondents to issue delay, detention and demurrage and ad-interim-relief may be allowed upon furnishing of security by the petitioner.
