M/s Muafis Enterprises approaches SHC against fixation of high transactional value of secondary quality coils

KARACHI: M/s Muafis Enterprises approached the Sindh High Court (SHC) against fixation of high transactional value of secondary quality coils imported from China and seeking release of its consignment.

On April 11, 2019, counsel for the petitioner stated in his constitutional petition that a consignment of the petitioner imported from China is lying at port and is being withheld from clearance by the customs authorities repeating their illegal practices in violation of customs tribunal’s order. The respondents have rejected the transactional value of the petitioner without giving any cogent reasons and assessed it exercising the illegal formula based on values taken from the London Metal Exchange.

He further submitted that quality of the goods imported by the petitioner in the instant petition is secondary quality coils which are different from prime quality coils as is reflected by the price difference (being approximately 30pc, 40pc less from secondary quality), packing difference, assortment of weights and sizes in the same consignment and certificates.

Citing secretary Ministry of Finance, Chief Collector of Customs Appraisement East, Director General Valuation and others as respondents, he pleaded the court to direct the respondents to release the consignments of the petitioner on their transactional value in accordance with Section 25 of the Customs Act, 1969 or give cogent reasons for denying the same in light of the principle of sequential application.

He further pleaded the court to restrain them from taking any coercive action against the petitioner till final order in this petition
