KARACHI: M/s Amir Gul & Sons approached the Sindh High Court (SHC) for clearance of consignment of plastic scrap which was marked by the appraising officer for examination as per status of goods declaration despite compliance of all legal formalities by the petitioner.
On June 15, 2019, counsel for the petitioner filed constitutional petition and argued that petitioner is sole proprietor and an industrial consumer engaged in the import of plastic waste and scrap in the brand name of M/s Amir Gul & Sons.
Counsel argued that petitioner is seriously aggrieved and highly prejudiced by the actions of the respondents, whereby the respondents are not processing the goods declarations filed by the petitioner on May 16, 2019 and May 18, 2019 for clearance of consignment of plastic scrap which was marked by the appraising officer for examination as per status of goods declaration despite compliance of all legal formalities by the petitioner.
He said that petitioner imported above-mentioned goods and filed goods declaration according with law, and consignment is accompanied by an NOC issued by Environmental Protection Agency Government of Khyber Pakhtunkhwa and pre-shipment inspection certificate issued by ABS consulting, the recognized company of exporting country as mentioned in Appendix-H of IPO.
He further argued that petitioner is duly complaint of the conditions of IPO 2016 and despite such compliance, goods declaration of the petitioner are not being processed as yet nor any objection has been raised and the same has been marked for examination on the same date when the goods declaration was filed however, till yet the examination of the goods has not yet been conducted resulting to which petitioner is facing enormous hardship and will have to pay demurrage, detention charges as well as container rents on release of the goods which are being incurred on daily basis of the above goods.
Citing chairman Federal Board of Revenue and the Collector of Customs Clectorate Port Muhammad Bin Qasim as respondents, court may please to release his consignment and restrain them from taking any coercive action against the petitioner.
