M/s Trade Linkers approaches SHC for release of refrigerator freezers’ consignment

KARACHI: M/s Trade Linkers approached the Sindh High Court (SHC) seeking release order for consignment of refrigerator freezer detained by customs officials due to disputed Valuation Ruling No 1036/2017 dated 8/2/2017.

On July 4, 2019, counsel for the petitioner stated in his constitutional petition that petitioner is a proprietorship concern engaged in the import and supply of household appliances namely refrigerator freezer and is seriously aggrieved and highly prejudiced by the actions of the customs officials, whereby the officials of the customs department are assessing the import consignment of refrigerator freezer from China and demanding duties and taxes on the basis of Valuation Ruling No 1036/2017 dated 8/2/2017.

He further argued that the subject goods in question do not fall under the category of refrigerators, therefore, there enhancement of value of the subject goods without assigning any reason and on the basis of individual discretion is unfair and unjustified in the eyes of law.

He said that the subject goods declaration is under assessment process and the petitioner is incurring heavy port demurrage and container detention charges accumulating on the daily basis for no fault of their own.

Citing chairman Federal Board of Revenue, collector of Customs Appraisement Port Muhammad Bin Qasim and Director Valuation as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, malafide and arbitrary.
