KARACHI: Saleem Khan Kahar, proprietor of M/s S & S Khan Enterprises approached the Sindh High Court (SHC) against detention of consignment of imported paper, plastic waste and scrap.
On July 10, 2019, counsel for the petitioner stated in his constitutional petition that petitioner is engaged in the business of import of paper and plastic waste and scrap and processing and recycling of latter at its manufacturing unit under periodic environmental approvals granted and approved from time to time by Environmental Protection Agency, Government of Baluchistan.
He further submitted that he petitioner imported four consignments of the subject goods. Among other kinds of waste and scrap from UAE and Poland under proper and requisite pre-shipment inspection company and filed goods declaration, however, to the petitioner’s extreme disappointment and dismay, finalization of the goods declaration, for the purposes of clearance and release of the subject goods, among other, however, was delay without so much as even assigning a pretext and for no reason and rhyme.
Counsel said three show cause notices were issued to the petitioner alleging that petitioner’s manufacturing unit not having the requisite processing/ recycling capacity to exceeding the permissible import quota to mis-declaration (due to presence of a miniscule quantity of a different kind of waste and scrap the possibility of presence of which is always real and existing in such consignments.
Citing chairman Federal Board of Revenue, Collector of Customs Port Muhammad Bin Qasim and others as respondents petitioner pleaded the court to declare issuing show cause notices and withheld the consignments as illegal and without-jurisdiction manner and court set aside show cause notice and direct them to release the consignments immediately.
