Aleem Khan challenges income tax levy in LHC

LAHORE: Pakistan Tehreek-i-Insaf (PTI) leader and former senior provincial minister Abdul Aleem Khan has challenged the income tax levy in Lahore High Court (LHC).

Aleem approached the Lahore High Court against Inland Revenue (IR) department of the Federal Board of Revenue (FBR) for recovery of income support levy.

Member of Provincial Assembly (MPA) Aleem Khan through his counsel submitted that the recovery of income support levy is a violation of different laws and the Constitution.

He pleaded that it is up to the provincial social welfare department to work towards the welfare of the public and after the 18th constitutional amendment the Inland Revenue department has no authority to impose and recover a tax in the name of social protection.

Counsel said the federal government did not have the authority to pass any legislation on the social welfare of the public at large.

He further prayed that the Income Support Levy Act 2013 was introduced for a period of one year only and the parliament did not extend its tenure. He therefore, argued, the action of the FBR is a sheer violation of the Constitution.
