Customs Court awards jail term to suspect in black gold smuggling case

KARACHI: The Customs Court awarded imprisonment which already undergone and fine Rs300,000 to 70 years old suspect Mahmood Ahmed son of Jan Muhammad, who was booked in a case of attempting to smuggle gold in February 12, 1989 and was declared proclaimed offender since 1989.

On July 23, 2019, the above mentioned suspect appeared before the court along with counsel and moved petition for plead guilty, after the hearing, court awarded imprisonment already undergone and fine Rs300,000 and if fine amount was not paid than he will further suffer for one month in Central Jail Karachi.

After awarding sentence, suspect paid fine amount, therefore, court directed jail authority to release him if he is not required in any other case.

According to the prosecution, on February 12, 1989 about 1.50 pm a police party headed by SHO Nisar Hussain Shah on suspicion intercepted his car near National Coaching Centre, Karachi and on search recovered 800 tolas gold which was in a black colour bag. After the formalities, he was arrested and case was registered against him.

As per First Information Report he was granted after arrest bail after three days and he escaped after granting bail and surrender himself in 2017 and court granted his bail due to 70 years old age.

According to the prosecution, case was registered by complainant for violation of under section 2 (s) (15) (16) of the Customs Act 1969 punishable under clause (89) of section 156 (i) ibid read with section 156 (2) of the customs act, 1969 further read with section 3 (1) of Imports & Export Control Act, 1950.
