M/s Grace Int’l approaches SHC seeking release order for detained consignment

KARACHI: M/s Grace International approached the Sindh High Court (SHC) and filed a petition seeking release order for consignment of contain air compressor scrap question in the light of order in customs appeal dated 18/05/2019 passed by the Customs Appellate Tribunal Karachi.

On September 26, 2019, counsel argued that customs department is refusing to release the consignment declared to contain air compressor scrap question in the light of order in customs appeal dated 18/05/2019 passed by the Customs Appellate Tribunal, bench-II Karachi in favor of the petitioner accordance with law.

He petitioner is suffering since 2018 despite the order passed by the appellant tribunal in favor of the petitioner and the petitioner paid duty and taxes to the respondents and the same is granted the delay and detention certificate to the petitioner but due to the demerge and detention charges the respondents not complying the same, that the consignment is lying in port area and the demerge charges of the respondent is increasing day by day.

He further submits that there is no stay against the said consignment of the petitioner, the act of the refusal release of the consignment by the respondents is ultra-viral and the violation of articles for 4, 24, 25 of the constitution of Islamic Republic of Pakistan and there is no other remedy available accept to file this petition before this court to provisionally release the consignment.

Citing secretary Revenue Division, The Collector of Customs MCC Appraisement West, The Operating Manager, Karachi International Container Terminal and others as respondents, petitioner pleaded the court may direct them to release its consignment and restrain them from taking any coercive action against the petitioner.
