KARACHI: M/s Nizam-baba Limited approached the Sindh High Court (SHC) seeking release order for its imported consignment of toiletries (perfume and body spray) 13,500 kilograms seized by customs officials claiming mis-declaration and disputed duties and taxes. On 30 October 2019, counsel argued that petitioner during the normal course of business activities, imported the consignment of toiletries (perfume and body spray) 1077 cartons, 13500 kg from UAE, dated 19/09/2019 against US% 10,770 vid Karachi in transit to Afghanistan through supporting documents. He further submits that customs officials framed seizure report and forwarded that to the adjudication authority which issued show cause notice with the allegation that the importer with the active connivance of authorized clearing agent, carrier and the shipping agent has willfully mis-declared the weight and unlawfully grounded the container in a private godown with the sole intention to misuse the Afghan transit facility and to bring the goods into Pakistan without payment of duty and taxes. Citing chairman Federal Board of Revenue, the Collector of Customs Appraisement West as respondents, petitioner pleaded the court to declare that the failure of the respondents to release the consignment against the duty and taxes in without justification & without jurisdiction, illegal, unlawful, capricious, malafide, arbitrary, discriminatory, ultra vires of the law and constitutional, equity and fairness.
