KARACHI: M/s R. W. H International has approached the Sindh High Court (SHC) and filed a petition against detention of consignments of imported polyester knitted pile fabric by Collector of Customs Appraisement West due to disputed valuation.
On 26 December 2019, counsel for the petitioner stated that M/s Khafid Garments imported polyester knitted pile fabric and the consignment was lying on port and before clearance the petitioner’s company M/s R.W.H International purchased the goods from M/s Khafid Garments.
He further argued that petitioner’s company after paying amount to M/s Khafid Garments, as per regulation of international shipping’s prescribed procedure M/s Khafid Garments had endorsed the set off original bill of lading in our client’s favour and also in accordance with the rules & regulations prescribed under customs act, 1969, the petitioner had filed the goods declarations on WeBOC system and paid all the duties and taxes into the government.
He said that after examination of consignments made by the customs officials confined the consignments of the petitioner and allegations leveled that the petitioner fraudulently tried his best for clearance of consignments of M/s Khafid Garments by filling GD in its own name is based on presumption and its assumption and contrary to law and the act of the respondent is illegal & unlawful in the eyes of law.
Citing secretary Revenue Division, the chief collector of Customs Appraisement West and others petitioner pleaded the court to declare that importer of goods in respect of which a valuation of ruling instrument under section 25A of the customs act, 1969 has been issued and has been challenged for any foreign having competent authority shall have the option of having consignment such goods provisionally assessed and released under section 81 of the customs act, 1969.
