KARACHI: M/s Alamgir, M/s Hamza Enterprises and M/s Prime International have approached the Sindh High Court (SHC) and filed constitutional petition against detention of their consignments of citric acid detained by customs officials due to dispute of valuation.
On 20 January 2020, counsel for the petitioners stated that they have imported consignments of the above mentioned goods at unit value of US$ 0.51 and filed goods declaration according with law and requested customs officials to finalize the assessment accordingly.
He submitted that however, customs officials without confronting the declared transaction denied to accept the same and proposed to assess the duty and taxes on the impugned valuation ruling no 1015/2017.
Counsel further argued that importers are seriously aggrieved and highly prejudiced by the actions of the respondents, who denied to accept the declared transaction of the impugned goods and is assessing the duty and taxes on the basis of the valuation ruling no 1015/2017.
He said that importers have exhausted all the departmental remedies and is left with no expeditious or efficacious remedy under law than to turn to this court under article 199 of the Constitution of Pakistan.
Citing chairman FBR, collector of Customs Appraisement East/ West and DG Valuation as respondents, petitioners pleaded the court to declare that non allowing provisional release of consignments is disregard/ disobeying to the orders on this court, therefore, court may direct them to release their consignments immediately and restrain them from taking any coercive action against the petitioners till final order in this case.
Counsel further pleaded the court to direct them to issue delay and detention certificate and grant any other relief deemed just and appropriate in the circumstances of the case.
