Customs Court approves charge sheet against M/s Oriental Chemical Industries

KARACHI: Customs court approved charge sheet against Syed Jawad Arshad son of Syed Monawar Ali, owner of M/s Oriental Chemical Industries and others and issued non-bail able warrants of absconding suspects, who are booked in a case of committing of tax fraud by obtaining sales tax refund on the strength of fake and flying invoices and false zero rated supplies without having any manufacturing facility.

On 8 February 2020, investigation officer of inland revenue zone-I submitted charge sheet against the above mentioned importer and other Muhammad Adnan Attari, Aftab Ali Asghar Ali, Amir Hussain, Mustafa, Muhammad Raheel, Zohaib and others.

According to the charge sheet, on an actionable information, FBR officials conducted investigation and during the investigation, it was revealed that the above mentioned suspect and registered and un-registered persons who are directly, indirectly, knowingly, dishonestly, fraudulently and without any lawful excuse are the beneficiaries and whose criminal negligence and connivance by any act or caused to do any act, omitted to take any action including the making of supplies of taxable goods without payment of sales tax leviable under sales tax act, 1990, fraudulently operated blacklisted without payment of sales tax have committed tax fraud as defined under section 2(37) of the sales tax act, 1990.

Investigation officer submitted that they evaded the sales tax amounting of Rs114,242,904, FIR is lodged accordingly, and further investigation in respect of owners of declared premises, buyers, suppliers and proprietor are in progress.

After the hearing, court approved charge sheet and issued NBWs against absconding suspects and directed investigation officer to arrest and produce them before the court on next date of hearing.
