KARACHI: The Sindh High Court (SHC) directed customs officials to make sure to file their para wise comments on a petition filed by M/s Nafeesur Rehman against detention of its 390 cartons of assorted artificial/ imitation jewelery, 19595 kg gross and 150 cartons containing assorted hair accessories, hair pins of assorted colors, designs & sizes alleged to be of Indian origin by customs officials.
On 19 February 2020, a two-member bench, headed by Justice Aqeel Ahmed Abbasi was hearing the matter.
During the hearing, counsel for the petitioner argued that irreparable loss is being incurred by the petitioner on daily basis due to unlawful and illegal detention of their subject locally purchased goods namely 390 cartons of assorted artificial/ imitation jewelery alleged to be of Indian origin by the customs officials weighing to be 19595 kg gross and 150 cartons containing assorted hair accessories, hair pins of assorted colors, designs & sizes alleged to be of Indian origin by customs officials against valid purchase, import documents and duly issued transportation bilties by the officers of the respondent.
He further argued that above mentioned goods was seized along with container and transporting Nissan Trawler on March 01, 2019 during transportation from Quetta to Karachi without inquiry and verification of the above mentioned documents obtained from the driver and occupant of the vehicle.
Citing secretary Revenue Division, collector of Customs Appraisement and the superintendent Preventive Services as respondents, petitioner is pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court to direct them release his consignment immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
