M/s Dawn Convertic Private Limited challenges Valuation Ruling No 1467/2020 in SHC

KARACHI: A division bench of the Sindh High Court (SHC) directed customs department to process application of the petitioner for provisional release of the subject consignment in terms of section 81 of the customs act, 1969 on a constitutional petition filed by M/s Dawn Convertic Private Limited imported papers in a bulk quantity.

On 9 November 2020, during the hearing Iftikhar Hussain advocate appeared before the court and argued that request of the petitioner for provisional release of the consignment during pendency of revision petition filed by the petitioner under section 25D of the customs act, 1969 in respect of valuation ruling no 1467/2020 dated Sep 07, 2020 is not being processed by the customs authorities despite repeated reminders.

He further argued that petitioner has intimated the order passed by this court on Oct 17 2020in the case of M/s Al Hammd International through secretary revenue and chairman FBR and others, wherein, customs department have been directed to passed appropriate orders on the applications filed by the importers seeking provisional release in terms of section 81 of the customs act, 1969 in accordance with law.

Counsel submitted that inaction on the part of the respondents is causing serious hardship to the petitioner and other importers, who are constrained to approach this court by filing constitutional petition under article 199 of the constitution of Islamic Republic of Pakistan 1973.

After the hearing, the court also issued notice to the customs department and deputy attorney general and directed them to file their respective para wise comments on the next date of hearing.
