SHC seeks reply on petition filed by M/s Spectrum Enterprises against refusal of releasing pay orders

KARACHI: A division bench of the Sindh High Court (SHC) issued notices to the customs officials and deputy attorney general on a constitutional petition filed by M/s Spectrum Enterprises against refusal of releasing pay order of Rs62,73,859 and Rs16,88,020 deposited at the time of provisionally release of consignments.

On 24 November, 2020, while the hearing, the bench headed by Junaid Ghafar also directed customs authorities to submit their respective para wise comments for the next date of hearing.

During the hearing, counsel for the petitioner stated that the petitioner is the law binding and peace loving citizen and he attends the notables respect in the society and known as one of honest person and respectfully submitted here under for your kind consideration and just order against the respondent and his subordinates who refused to release pay order dated August 5, 2019 sum of Rs62, 73, 859 and pay orders dated August 05, 2020 sum of Rs16, 88, 020 issued by Meezan Bank West Wharf Branch deposited at the time of provisionally release of consignment under section 81 of the customs act, 1969 read with CGO 09 of 2007 serial no 66 which was deposited in GD No KPPI-HC98934-28-06-2019 dated August 03, 2019 and GD No KPPI-HC-98935-28-06-2019 dated August 03, 2019.

Citing secretary Ministry of Finance, chief collector of Customs Port Muhammad Bin Qasim, collector of Customs Port Muhammad Bin Qasim and Deputy Collector of Customs Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to direct them to return the abovementioned pay orders to the petitioner.

He further pleaded the court to restrain them and their officer from taking any coercive action against the petitioner till the disposal of petition.
