Importers move SHC seeking provisionally release of consignments of PVC coating fabric, PU coated fabric etc

KARACHI: M/s Asad Traders, M/s Soban Traders, M/s Mujahid Enterprises, M/s Dogar Impex and others have approached the Sindh High Court (SHC) and filed constitutional petitions seeking provisionally release of PVC coating fabric, PU coated fabric (artificial leather) woven and nonwoven and textile lining material fabric on securing the differential amount of duty and taxes.

On 30 November 2020, counsel for the petitioners stated that petitioners are duly registered business concern and engaged in import and trading of various items, inter alia, including artificial leather PVC polyurethane coated fabrics and textile lining material/ coated fabric, the commodity is imported from worldwide sources and mainly from China, appellant enjoys an unblemished reputation in the industrial and business circle having spotless record towards payment of government’s legitimate revenue in accordance with law.

Being aggrieved with and dissatisfied by inaction and refusal on part of the respondents for allowing release of consignments of PVC PU coated fabric lying at port, whereas, the customs appeal under section 194A of the customs act, 1969, before customs appellate tribunal, Karachi upholding exorbitant customs values of determined vide valuation ruling no 1450/ 2020 dated June 06, 2020, which appeal is still sub-judice before customs appellate tribunal, Karachi, which is even not functional.

Citing chairman FBR, DG valuation and others as respondents, petitioners pleaded the court to suspend the operation of impugned order-in-revision no 27/2020 dated Sep 25, 2020 and impugned valuation ruling 1450/2020 dated June 06, 2020 till the final disposal of the instant petition.

He further pleaded the court to direct them to issue necessary directions to clearance collectors to provisionally release the commodities PVC Coating Fabric, PU Coated Fabric (Artificial Leather) woven and non-woven and textile lining material fabric on securing the differential amount of duty and taxes.
